Today, digital devices have become essential devices to the point where everybody uses a smartphone. In a criminal investigation that requires tracking the suspect's past movements, whether or not information stored in a digital device is searched and seized can determine the success of the investigation.
The search and seizure of digital devices is called compulsory disposition that greatly infringes on people's privacy. However, the current Criminal Procedure Act does not provide any concrete provisions on the method of collecting such digital information, and its legality is left to the court's ex post judgment. This situation causes various problems regarding privacy and can lead to much bigger issues in many other cases.
Accordingly, Seung Woo Lee would like to review and compare Korea's criminal trial law-related regulations and precedents with those of the United States and examine how to conduct search and seizure in the future. He aims to explain the legal issues involved with “Search and seizure of digital devices” and to present possible solutions to these issues in Korea’s court system.
