The objective of criminal procedure is to discover the truth as it is, under the due process of law. However, the investigation of the police and prosecution must be accompanied by the legal invasion to the rights of people. Therefore, the constitutional law must authorize judges to judge the legality and rightness of an arrest and a search operation made by the police and prosecution. In this presentation, Mr. Dae Hyun Kim will introduce the outline of South Korean criminal procedure, especially focusing on the tasks of the judges during criminal investigation of the police and prosecution.
